Introduction


Captain's Choice
Captain's Choice ("the Contest"), presented by SportsLine.com, Inc. ("SportsLine") and PGA TOUR Licensed Properties, Inc., ("PGA TOUR") is a great way for you to experience the excitement of the Champions Tour and Nationwide Tour! During each week on the schedules listed below, participants will select a single player from the Champions Tour playing field and a single player from the Nationwide Tour field (in weeks where only one Tour is scheduled, you'll select a single player from that tour field). Your score for the week will equal your selected players' money winnings (US dollars) in the tournaments. The Contest Period ("Contest Period") will consist of 28 weeks beginning on April 21st, and one grand prize will be awarded at the end of the Contest Period to the overall top scorer. Your team will not carry over from week to week, so you must pick a new team each week. Limit one entry per person.

Administrator
SportsLine.com, Inc. will serve as the administrator ("Administrator") of Captain's Choice and will be responsible for resolving any disputes that arise regarding violations of the rules or anything else that may come up.

Eligibility
To be eligible to participate in the Contest, you must be (a) a Registered User (b) legal resident of one (1) of the fifty (50) United States or Washington DC; (for purposes of clarity, Puerto Rico is expressly excluded) (c) at least eighteen (18) years of age or older (except in Alabama and Nebraska where you must be 19 years of age or older) at the date of entry in this Contest. For purposes of these Official Rules ("Official Rules") "Registered User" means a person who has successfully completed the registration form and has obtained a User Identification ("ID") and associated password ("Password") on one or more of the following Web sites: CBS.com, CBSnews.com, CBS SportsLine.com, upn.com, NFL.com, NCAAsports.com, SuperBowl.com and/or PGATOUR.com. If you are not a Registered User you may become a Registered User and obtain an ID and a Password by completing the SportsLine Service registration form by going here on the SportsLine Service. There is no fee or charge to you to become a Registered User. Void where prohibited by law. Excluded residents may play, but are NOT eligible to receive any prizes.

Employees of SportsLine, CBS Broadcasting Inc. and the PGA TOUR (collectively the "Contest Entities") and each of their parent companies, affiliates, subsidiaries, advertising, promotion and fulfillment agencies and members of the immediate family or household of each are not eligible to win prizes. Immediate family member is defined as a parent, sibling or any person residing in the same household as an employee of the Contest Entities. Void where prohibited. Such excluded employees and/or family members may play, but WILL NOT be eligible to receive any prizes.

Golf Team


Selecting Your Team
Each week throughout the Contest Period you will be required to select two golfers: one each from the Nationwide Tour and Champions Tour tournament fields. During weeks where only one tournament is played, you will be required to select one golfer from that tournament field. If you do not make a selection for a tournament, you will not receive any points that week.

Note: The golfer selection page for the new week is always updated on Monday evenings, and then locked until the following Monday. The list of golfers will not change, even if certain golfers are added to a tournament field or scratched from it, after we open the selection page on the Monday before a tournament. It is the participant's responsibility to consult the PGATOUR.COM tournament field page to determine whether a golfer is playing in that tournament.

Participants will be able to change the golfer(s) they selected at any time until the selection deadline passes (see paragraph below for deadlines). This will allow participants to check a golfer's status for the week's tournament and make any necessary changes.

Team Selecting Deadline
Each week of the Contest Period will consists of one or two tournaments (see the "Scheduled Tournaments" section below.) Weeks typically run Thursday through Sunday (some weeks begin on Friday, so check the Scheduled Tournaments each week.)The deadline for picking your team each week is 6:00 AM ET (Eastern Standard Time) the day of the first round of the first tournament that week. If an overseas tournament begins prior to 6:00 AM Eastern Standard Time, then the deadline is 1 hour prior to the beginning of the first round of the tournament. If you fail to select a team for a certain tournament period, you will be awarded zero points toward your overall total score. Although it isn't necessary to participate each week, it is strongly encouraged since missing a week will reduce your chances of winning.

Winner Notification
Winners will be notified via the valid e-mail address that was entered when signing up for the Contest. Notification will be made for all prizes within four (4) weeks following the completion of the Contest to allow time for the verification of all data and scores.


Scoring


Points
Your score for any given week will be equal to the US dollar winnings of your selected player(s). A cumulative score will be kept for each segment of the Contest.


Prizes


Grand Prize(the "Grand Prize")
The eligible top point-scorer ("First place finisher") at the completion of the Contest will win:

  • One (1) trip to their choice of either the 2007 Charles Schwab Cup Championship OR the 2007 Nationwide Tour Championship.
  • Grand Prize includes: Roundtrip airfare for two (2) to/from the site of either the 2007 Charles Schwab Cup Championship OR the 2007 Nationwide Tour Championship, from a major airport closest to the winner's home. Four (4) night hotel accommodations for two (2). Passes for two (2) to attend all four (4) rounds of either the 2007 Charles Schwab Cup Championship OR the 2007 Nationwide Tour Championship.
  • Approximate Retail Value ("ARV") of the Grand Prize: Three-thousand five-hundred US dollars ($3,500.00). PLEASE NOTE: Grand Prize Winner (the "Grand Prize Winner") and Grand Prize Winner's travel companion is/are responsible for all ground transportation. Any difference between the ARV set forth above and the actual costs of the prize will not be awarded.

    In case there is a tie for the Grand Prize, the tied participants will be compared and the winner will be determined in the following manner:
    1. Greatest number of weeks in the Contest Period making a selection.
    2. Most points won in the final week of the Contest Period.
    3. Most points won in each previous weeks starting from the last week of the Contest Period moving back to the first week of the Contest Period (previous weeks are reviewed one at a time until the tie is broken).
    4. Random drawing.


    Prize Restrictions
    Actual value of trip may vary based on point of departure and dates of travel. Certain travel restrictions may apply. If Grand Prize Winner resides within a 100 mile radius of host city, ground transportation may be provided in lieu of air transportation and no compensation or substitution will be provided for difference in prize value. The Grand Prize Winner and guest(s) will be required to travel together on the same itinerary and are responsible for obtaining all required travel documents. Grand Prize Winner and guest(s) must be available to travel on dates specified by PGA TOUR. Travel arrangements must be made through PGA TOUR. The guest(s) must be eighteen (18) years of age or older (except in Alabama and Nebraska where you must be 19 years of age or older) and will be required to execute and return liability/publicity (unless prohibited by law) releases prior to ticketing. No assignment, transfer, conversion to cash or cash redemption or substitution of the Grand Prize is permitted, except Administrator reserves the right to substitute the Grand Prize or any of its components with a prize of comparable or greater value should the Grand Prize or any of its components become unavailable. Grand Prize is solely for personal use and may not be used in conjunction with any other promotion.


    Legal Disclaimers

    All participants agree to abide by the terms of these Official Rules and the Legal Disclaimers below, and by the decisions of Administrator, which are final and binding on all matters pertaining to the game.

    General Conditions
    By entering this Contest, each entrant accepts and agrees to be bound by these Official Rules and by the decision of the Administrator, which shall be final and binding in all respects. Further, each entrant also acknowledges and agrees to the SportsLine Terms of Service, including, without limitation, the SportsLine Acceptable Use Policy. Taxes are the sole responsibility of the Grand Prize Winner. No transfer of any prizes in this Contest is permitted except by Administrator.

    The Grand Prize Winner will be required to submit valid identification to Administrator and to execute an Affidavit of Eligibility/ Liability Release and where lawful, a Publicity Release (collectively the "Release Forms"), notarized within the state/province of legal residence, thirty (30) days following first attempted notification. Failure to comply within this time period may result in disqualification and the awarding of a prize to the entrant with the next highest score.

    Except where prohibited by law, the Grand Prize Winner's acceptance of the Grand Prize constitutes permission for the Contest Entities to use Grand Prize Winner's name, photograph, likeness, statements, biographical information, voice, and address (city and state) worldwide and in all forms of media, in perpetuity, without further compensation. Entrants agree to Administrator's use of their names and likeness for advertising and publicity purposes, without additional compensation, unless prohibited by law.

    Administrator, in its sole discretion, may disqualify any entrant from participating in the Contest, refuse to award points or prizes, and require the return of any prizes, if entrant engages in any conduct Administrator deems to be improper, unfair or otherwise adverse to the operation of the Contest or detrimental to other entrants. Such improper conduct includes, but is not limited to, falsifying personal information required during Contest registration or prize claim, violating any term or condition stated herein, accumulating points or prizes through methods such as automated computer scripts or other programming techniques, allowing others to use the entrant's personal information for the purpose of accumulating points or prizes, tampering with SportsLine's administration of this promotion, or intentionally trying to defraud, reverse engineer, disassemble, decompile or otherwise tamper with the computer programs on this Web site. Entrant further acknowledges that the forfeiture of prize(s) and/or return of any prize(s) shall in no way prevent Administrator from pursuing other avenues of recourse such as criminal or civil proceedings in connection with such conduct. CAUTION: ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, ADMINISTRATOR RESERVES THE RIGHT TO SEEK DAMAGES AND ANY OTHER REMEDIES FROM ANY SUCH ENTRANT TO THE FULLEST EXTENT PERMITTED BY LAW.

    Administrator is not responsible for lost, late or misdirected on-line entries, for incorrect, inaccurate or incomplete entry information whether caused by an entrant, equipment, or technical malfunction or for any human error, technical error or malfunctions. Administrator reserves the right to halt or modify the Contest at any time during the Contest Period if events beyond its control compromise the Contest's fairness or integrity. In the event that a scheduled tournament is canceled or preempted for any reason, no points will be awarded for that game for the affected teams. All other games will be scored per the scoring rules. In the event that a selected player does not participate or is disqualified, no points will be awarded for that player. All other games for which a participant selects players will be scored based on scoring rules.

    Administrator is not responsible for typographical or other human or technical errors in the offer or administration of this Contest, including but not limited to errors in advertising, the Official Rules, the selection and announcement of the winner or the distribution of the prizes hereunder. Administrator, in its sole discretion, may disqualify any entrant from participating in the Contest, refuse to award points or prizes, and require the return of any prizes, if entrant engages in any conduct Administrator deems to be improper, unfair or otherwise adverse to the operation of the Contest or detrimental to other entrants. Such improper conduct includes, but is not limited to, falsifying personal information required during the Contest registration or prize claim, violating any term or condition stated herein, accumulating points or prizes through methods such as automated computer scripts or other programming techniques, allowing others to use the entrant's personal information for the purpose of accumulating points or prizes, tampering with the administration of this Contest, or intentionally trying to defraud, reverse engineer, disassemble, decompile or otherwise tamper with the computer programs on the CBS SportsLine Web site or the PGA TOUR Web site.     Administrator reserves the right to modify these Official Rules for clarification purposes without materially affecting the terms and conditions of the Contest.

    This Contest may not be used for any form of gambling.

    Internet
    If for any reason the Contest is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of Administrator which corrupt or affect the administration, security, fairness, integrity, or proper conduct of this Contest, Administrator reserves the right, at its sole discretion, to disqualify any individual who tampers with the entry process, and to cancel, terminate, modify or suspend the Contest. In such event, Administrator further reserves the right to award the prizes to the players with the most points as of the termination date.

    Administrator assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries or transactions. Administrator is not responsible for any problems or technical malfunction of any telephone network or lines, computer on-line systems, servers, or providers, computer equipment, software, failure of any e-mail entry or transaction to be received on account of technical problems or traffic congestion on the Internet or at any Web site, or any combination thereof, including any injury or damage to participant's or any other person's computer related to or resulting from participation or downloading any materials in this Contest.

    The Contest Entities, and their parents, affiliated and subsidiary companies and advertising and promotion agencies, assume no liability and are not responsible for, and you hereby forever waive any rights to any claim in connection with, lost, late, incomplete, corrupted, stolen, misdirected, illegible or postage due entries or mail if applicable; or for any computer, telephone, cable, network, satellite, electronic or Internet hardware or software malfunctions, unauthorized human intervention, or the incorrect or inaccurate capture of entry or other information, or the failure to capture any such information. The Contest Entities, and their parents, affiliated and subsidiary companies, advertising and promotion agencies, are not responsible for any incorrect or inaccurate information, whether caused by registration information submitted by end users or tampering, hacking, or by any of the equipment or programming associated with or utilized in this Contest, and assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to the Contest.

    CAUTION: ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, ADMINISTRATOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH ENTRANT TO THE FULLEST EXTENT PERMITTED BY LAW.

    In the event of a dispute, entries will be declared made by the authorized account holder of the email address submitted at time of entry. "Authorized account holder" is defined as the natural person who is assigned to an e-mail address by an Internet access provider, on-line service provider or other organization (e.g., business, educational institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address.

    Any entry that is incomplete, late, does not include a validly issued User ID will be disqualified.

    In the event that the Contest is challenged by any legal or regulatory authority, Administrator reserves the right to discontinue or modify the Contest, or to disqualify participants residing in the affected geographic areas. In such event, Administrator shall have no liability to any entrants who are disqualified due to such an action.

     
    Release and Indemnity
    Each entrant in the Contest, including, without limitation, the prize winner, hereby release and agree to hold harmless Administrator, CBS Broadcasting Inc. and the PGA TOUR and their parents, affiliates, subsidiaries, advertising and promotion agencies and their respective directors, officers, employees, representatives and agents from any and all liability for any injuries, loss or damage of any kind to person, including death, and property, arising in whole or in part, directly or indirectly, from acceptance, possession, use or misuse of the prizes hereunder, participation in this Contest and participation in any activity related to this Contest.

     
    Limitation of Liability and Disclaimer of Warranties
    IN NO EVENT WILL ADMINISTRATOR, CBS BROADCASTING INC., THE PGA TOUR AND/OR THEIR PARENTS, AFFILIATES, SUBSIDIARIES AND RELATED COMPANIES, THEIR ADVERTISING OR PROMOTION AGENCIES OR THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, REPRESENTATIVES AND AGENTS, BE RESPONSIBLE OR LIABLE FOR ANY DAMAGES OR LOSSES OF ANY KIND, INCLUDING DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES ARISING OUT OF YOUR ACCESS TO AND USE OF THE CBS SPORTSLINE SITE AND/OR THE CONTEST, DOWNLOADING FROM AND/OR PRINTING MATERIAL DOWNLOADED FROM THE SERVICE AND/OR THE CONTEST. WITHOUT LIMITING THE FOREGOING, EVERYTHING ON THE CONTEST AND THE CBS SPORTSLINE SITE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT. SOME JURISDICTIONS MAY NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES OR EXCLUSION OF IMPLIED WARRANTIES SO SOME OF THE ABOVE LIMITATIONS OR EXCLUSIONS MAY NOT APPLY TO YOU. CHECK YOUR LOCAL LAWS FOR ANY RESTRICTIONS OR LIMITATIONS REGARDING THESE IMITATIONS OR EXCLUSIONS.

     
    Arbitration
    The parties waive all rights to trial in any action or proceeding instituted in connection with these Official Rules, including, without limitation, the Contest. Any controversy or claim arising out of or relating to these Official Rules and/or the Contest shall be settled by binding arbitration in accordance with the commercial arbitration rules of the American Arbitration Association. Any such controversy or claim shall be arbitrated on an individual basis, and shall not be consolidated in any arbitration with any claim or controversy of any other party. The arbitration shall be conducted in the State of New York, in the City of New York, County of New York.

    Governing Law and Jurisdiction
    THESE OFFICIAL RULES AND THE INTERPRETATION OF ITS TERMS SHALL BE GOVERNED BY AND CONSTRUED IN ACCORDANCE WITH THE LAWS OF THE STATE OF NEW YORK WITHOUT REGARD TO ITS CONFLICTS OF LAWS RULES. For any matters which are not subject to arbitration as set forth in these Official Rules and/or in connection with the entering of any judgment on an arbitration award in connection with these Official Rules and/or the Contest, the parties irrevocably submit and consent to the exclusive jurisdiction and venue of the New York state and federal courts located in the City of New York, County of New York, and State of New York. The parties agree not to raise the defense of forum non conveniens.
